SCC strikes down victim fine surcharge: R v Boudreault

On December 15, 2018, the Supreme Court issued a remarkable decision holding that the victim fine surcharge, in place for 30 years but made mandatory by the previous Conservative government, was a violation of the Charter’s prohibition against cruel and unusual punishment.  Boudreault is the first decision authored by the Court’s newest justice, Shelagh Martin, though it spurred a vigorous 2-judge dissent.
